predpismi, ktor\u00e9 upravuj\u00fa maxim\u00e1lny priemern\u00fd pracovn\u00fd \u010das.\u00a0<span style=\"text-align: var(--text-align);\">Cie\u013eom eur\u00f3pskeho pracovn\u00e9ho pr\u00e1va je podporova\u0165 fyzick\u00e9 a du\u0161evn\u00e9 zdravie pracovn\u00edkov t\u00fdm, \u017ee ich chr\u00e1ni pred nadmern\u00fdm pracovn\u00fdm \u010dasom.<\/span><\/p>\n<p><\/p>\n<h2>Charta z\u00e1kladn\u00fdch pr\u00e1v Eur\u00f3pskej \u00fanie<\/h2>\n<p>Pr\u00e1vo na spravodliv\u00e9 pracovn\u00e9 podmienky je stanoven\u00e9 v <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:12012P\/TXT\" data-type=\"link\" data-id=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:12012P\/TXT\" rel=\"nofollow noopener\" target=\"_blank\">Charter of Fundamental Rights of the European Union<\/a>.\u00a0<span style=\"text-align: var(--text-align);\">Pod\u013ea \u010dl\u00e1nku 31 ods. 2 charty m\u00e1 ka\u017ed\u00fd pracovn\u00edk pr\u00e1vo na obmedzenie maxim\u00e1lneho pracovn\u00e9ho \u010dasu, ako aj na denn\u00fd a t\u00fd\u017edenn\u00fd odpo\u010dinok a ro\u010dn\u00fa platen\u00fa dovolenku.<\/span><\/p>\n<p><\/p>\n<h2>Pr\u00e1vna sila charty<\/h2>\n<p><a href=\"https:\/\/klucka.org\/charter-of-fundamental-rights-of-the-european-union\/\">Charta<\/a> je n\u00e1vrh z\u00e1kona o \u013eudsk\u00fdch pr\u00e1vach E\u00da a je s\u00fa\u010das\u0165ou prim\u00e1rneho pr\u00e1va E\u00da. \u010cl\u00e1nok 6 ods. 1 Zmluvy o Eur\u00f3pskej \u00fanii prizn\u00e1va charte rovnak\u00fa pr\u00e1vnu silu ako zmluv\u00e1m, na ktor\u00fdch je \u00dania zalo\u017een\u00e1 (Zmluva o Eur\u00f3pskej \u00fanii a Zmluva o fungovan\u00ed Eur\u00f3pskej \u00fanie).\u00a0<span style=\"text-align: var(--text-align);\">Ako sa uv\u00e1dza v \u010dl\u00e1nku 53 charty a ako uviedol S\u00fadny dvor Eur\u00f3pskej \u00fanie, \u00farove\u0148 ochrany z\u00e1kladn\u00fdch pr\u00e1v stanoven\u00e1 chartou sa v\u017edy pova\u017euje za minim\u00e1lny \u0161tandard pre vn\u00fatro\u0161t\u00e1tne opatrenia na vykon\u00e1vanie pr\u00e1va E\u00da (vec C-617\/10, \u00c5kerberg Fransson, bod 29).<\/span><\/p>\n<p><\/p>\n<figure class=\"wp-block-image \u010dase<\/h2>\n<p>Spolo\u010dn\u00e9 minim\u00e1lne normy pre organiz\u00e1ciu pracovn\u00e9ho \u010dasu v \u010dlensk\u00fdch \u0161t\u00e1toch s\u00fa stanoven\u00e9 v <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:32003L0088\" data-type=\"link\" data-id=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:32003L0088\" rel=\"nofollow noopener\" target=\"_blank\">Eur\u00f3pska smernica o pracovnom \u010dase<\/a> (<em>Smernica Eur\u00f3pskeho parlamentu a Rady 2003\/88\/ES zo 4. novembra 2003 o niektor\u00fdch aspektoch organiz\u00e1cie pracovn\u00e9ho \u010dasu<\/em>).\u00a0<span style=\"text-align: var(--text-align);\">Smernica je k\u013e\u00fa\u010dovou s\u00fa\u010das\u0165ou pracovn\u00e9ho pr\u00e1va E\u00da, ktorej cie\u013eom je chr\u00e1ni\u0165 zdravie a bezpe\u010dnos\u0165 pracovn\u00edkov pred rizikami, ktor\u00e9 predstavuje nadmern\u00e1 pr\u00e1ca alebo nedostato\u010dn\u00fd \u010das odpo\u010dinku.<\/span><\/p>\n<p><\/p>\n<h2>Maxim\u00e1lny po\u010det pracovn\u00fdch hod\u00edn a prest\u00e1vok na odpo\u010dinok<\/h2>\n<p>Pod\u013ea smernice mus\u00ed ka\u017ed\u00fd \u010dlensk\u00fd \u0161t\u00e1t (minim\u00e1lne) zabezpe\u010di\u0165, aby maxim\u00e1lny priemern\u00fd pracovn\u00fd \u010das zamestnancov nepresiahol 48 hod\u00edn t\u00fd\u017edenne vr\u00e1tane nad\u010dasov.\u00a0<span style=\"text-align: var(--text-align);\">Pri v\u00fdpo\u010dte 48-hodinov\u00e9ho limitu sa t\u00fd\u017edenn\u00fd pracovn\u00fd \u010das m\u00f4\u017ee spriemerova\u0165 najviac za 4 mesiace (\u0161tandardn\u00e9 ustanovenie), 6 mesiacov (zo z\u00e1kona, pri ur\u010dit\u00fdch \u010dinnostiach) alebo 12 mesiacov (len na z\u00e1klade kolekt\u00edvneho vyjedn\u00e1vania).<\/span><\/p>\n<p><\/p>\n<p><\/p>\n<h2>Minim\u00e1lna doba odpo\u010dinku a ro\u010dn\u00e1 dovolenka<\/h2>\n<p>Smernica tie\u017e stanovuje minim\u00e1lny denn\u00fd a t\u00fd\u017edenn\u00fd odpo\u010dinok, minim\u00e1lnu platen\u00fa ro\u010dn\u00fa dovolenku a dodato\u010dn\u00fa ochranu pracovn\u00edkov pracuj\u00facich v noci.\u00a0<span style=\"text-align: var(--text-align);\">Je v\u0161ak d\u00f4le\u017eit\u00e9 zd\u00f4razni\u0165, \u017ee jednotliv\u00e9 \u010dlensk\u00e9 \u0161t\u00e1ty m\u00f4\u017eu zavies\u0165 z\u00e1kony, ktor\u00e9 s\u00fa pre zmluvy<\/h2>\n<p>V roku 2021 sa S\u00fadny dvor Eur\u00f3pskej \u00fanie zaoberal ot\u00e1zkou viacer\u00fdch pracovn\u00fdch zml\u00fav jedn\u00e9ho zamestnanca u toho ist\u00e9ho zamestn\u00e1vate\u013ea. S\u00fadny dvor sa zaoberal ot\u00e1zkou, \u010di smernica stanovuje absol\u00fatne limity v pr\u00edpade s\u00fabe\u017en\u00fdch zml\u00fav s jedn\u00fdm alebo viacer\u00fdmi zamestn\u00e1vate\u013emi, alebo \u010di sa ustanovenia smernice vz\u0165ahuj\u00fa na ka\u017ed\u00fd pracovn\u00fd pomer osobitne. S\u00fadny dvor rozhodol, \u017ee minim\u00e1lna denn\u00e1 doba odpo\u010dinku sa vz\u0165ahuje na zmluvy ako celok, a nie na ka\u017ed\u00fa z nich osobitne.<\/p>\n<p><\/p>\n<h2>Eur\u00f3psky pilier soci\u00e1lnych pr\u00e1v<\/h2>\n<p>Zabezpe\u010denie zdrav\u00fdch a bezpe\u010dn\u00fdch pracovn\u00fdch podmienok je jednou z koncepci\u00ed Eur\u00f3pskeho piliera soci\u00e1lnych pr\u00e1v (EPSR). Pilier stanovuje <a href=\"https:\/\/ec.europa.eu\/social\/main.jsp?catId=1606&amp;langId=en\" data-type=\"link\" data-id=\"https:\/\/ec.europa.eu\/social\/main.jsp?catId=1606&amp;langId=en\" rel=\"nofollow noopener\" target=\"_blank\">20 k\u013e\u00fa\u010dov\u00fdch z\u00e1sad<\/a> v ktorom sa uv\u00e1dzaj\u00fa z\u00e1kladn\u00e9 pr\u00e1va a podporn\u00e9 mechanizmy nevyhnutn\u00e9 na zlep\u0161enie \u017eivotn\u00fdch a pracovn\u00fdch podmienok, ako aj na zv\u00fd\u0161enie soci\u00e1lnych \u0161tandardov v \u010dlensk\u00fdch \u0161t\u00e1toch E\u00da.\u00a0<span style=\"text-align: var(--text-align);\">Medzi t\u00fdmito z\u00e1sadami sa z\u00e1sada 10 osobitne zaober\u00e1 v\u00fdznamom zdrav\u00e9ho, bezpe\u010dn\u00e9ho a dobre prisp\u00f4soben\u00e9ho pracovn\u00e9ho prostredia (<\/span><em style=\"text-align: var(--text-align);\">Zdrav\u00e9, bezpe\u010dn\u00e9 a dobre prisp\u00f4soben\u00e9 pracovn\u00e9 prostredie a ochrana \u00fadajov<\/em><span style=\"text-align: var(--text-align);\">).
